TERMS OF SALE

1. SELLER AND SCOPE

These Terms of Sale govern sales made through https://oxary.co by OXARY, a French sole proprietorship operated by Mahamat Abakar Hassan, 39 rue de la Wantzenau, 67116 Reichstett, France. SIREN: 994 034 130. Email: contact@oxary.co. Telephone: +33 7 58 05 32 56.

By placing an order, the customer confirms that they have read and accepted these Terms of Sale before payment.

2. PRODUCTS

OXARY sells cosmetic and skincare products designed for skin in motion. Product descriptions, essential characteristics, ingredients, sizes, prices and usage instructions are shown on the relevant product page. Images are illustrative and minor differences that do not affect essential characteristics may occur.

The customer must review the ingredient list and follow all precautions for use, particularly in the event of allergies, sensitivities or a known medical condition. Product information does not replace medical advice.

3. PRICES, TAXES AND DELIVERY COSTS

Prices are shown in euros and include all taxes where applicable. OXARY is currently not subject to VAT under Article 293 B of the French General Tax Code. Delivery charges are added separately and shown before the order is confirmed.

For deliveries outside the European Union, customs duties, import taxes and local charges may be payable by the customer unless the checkout expressly states otherwise.

4. ORDERS

The customer selects the products, quantities and delivery method, checks the order summary and accepts these Terms of Sale before payment. The order becomes final once payment is accepted and an order confirmation has been sent.

OXARY may refuse or cancel an order in the event of payment failure, suspected fraud, an obvious pricing error, abnormal quantities, unavailability or a previous unresolved payment dispute. Any amount collected for a cancelled order will be refunded.

5. PAYMENT

Payment is due in full at checkout using the payment methods displayed on the website. Payments are processed by secure payment providers. OXARY does not store complete bank card details.

6. AVAILABILITY

Products are offered subject to availability. If an item becomes unavailable after an order is placed, OXARY will notify the customer and either offer an alternative, postpone shipment with the customer’s agreement or refund the unavailable item.

7. PREPARATION, SHIPPING AND DELIVERY

Orders are prepared from France. Available carriers, delivery methods, prices and estimated delivery times depend on the destination, parcel weight and order value and are displayed at checkout. Timeframes are estimates unless a guaranteed service is expressly stated.

The customer is responsible for providing a complete and accurate address and, where required, selecting or confirming a pickup point. Additional costs caused by an incorrect address, an uncollected parcel or a second shipment may be charged to the customer where permitted by law.

Risk of loss or damage passes to the consumer when the consumer, or a third party designated by them other than the carrier, takes physical possession of the goods. The customer should report a damaged or missing parcel promptly to contact@oxary.co and include photographs where possible.

8. STATUTORY RIGHT OF WITHDRAWAL

Consumers in the European Union have 14 days from receipt of the goods to notify OXARY of their decision to withdraw, without giving a reason. The customer must then return the goods within 14 days of that notification.

The request must be sent to contact@oxary.co with the order number and a clear statement of withdrawal. The customer may use the statutory withdrawal form but is not required to do so.

Subject to the legal conditions, OXARY will reimburse the amount paid for the returned products and the cost of the least expensive standard outbound delivery method. Return shipping costs are borne by the customer unless the product is defective, incorrect or OXARY agrees otherwise. Reimbursement may be withheld until the goods are received or proof of shipment is provided.

9. HYGIENE EXCEPTION FOR COSMETICS

For health protection and hygiene reasons, the right of withdrawal does not apply to sealed goods that have been unsealed after delivery when they cannot be returned for hygiene reasons. Opened, used, tested or unsealed cosmetic products may therefore be refused unless they are defective, non-conforming or were supplied incorrectly.

10. OXARY 30-DAY COMMERCIAL RETURN POLICY

In addition to the 14-day statutory right, OXARY offers a commercial return period of up to 30 days after receipt. To qualify, products must be unused, unopened, untested, in their original packaging and in resalable condition. This commercial extension does not reduce the customer’s statutory rights.

The customer must obtain return instructions before shipping. Items sent without identification or to an unauthorised address may be delayed or refused. Return shipping is at the customer’s expense unless the item is defective, damaged or incorrect.

11. LEGAL GUARANTEES

Consumers benefit from the French statutory guarantee of conformity and the guarantee against latent defects, independently of any commercial guarantee.

Under the statutory guarantee of conformity, the consumer may act within two years of delivery. Depending on the legal conditions and the nature of the product, the consumer may request replacement, a price reduction or cancellation of the sale. The legal guarantee against latent defects may be invoked within two years of discovering the defect.

To make a claim, contact contact@oxary.co with the order number, a description of the issue and supporting photographs where relevant.

12. USE OF PRODUCTS AND LIABILITY

Products must be used in accordance with their label, instructions and precautions. OXARY is not liable for damage resulting from misuse, failure to observe precautions, use after expiry or an individual reaction that could not reasonably be anticipated, subject to liability that cannot be excluded by law.

13. PERSONAL DATA

Personal data is processed for order fulfilment, customer service, fraud prevention and other purposes described in the Privacy Policy.

14. INTELLECTUAL PROPERTY

OXARY trademarks, logos, text, photographs, graphics, product names and other website content are protected. No reproduction, adaptation, distribution or commercial use is permitted without prior written authorisation, except where allowed by law.

15. FORCE MAJEURE

Neither party is liable for a failure or delay caused by an event beyond its reasonable control and recognised as force majeure under applicable law. OXARY will inform the customer and take reasonable steps to limit the effects.

16. COMPLAINTS AND CONSUMER MEDIATION

Complaints should first be sent to contact@oxary.co. If a written complaint remains unresolved, the consumer may use the consumer mediator appointed by OXARY free of charge.

17. APPLICABLE LAW AND DISPUTES

These Terms of Sale are governed by French law, without depriving consumers of mandatory protections available in their country of residence. Consumers may bring proceedings before the courts having jurisdiction under applicable consumer law.
