TERMS AND CONDITIONS OF SALE

1. Seller identity

The oxary.co website is operated by OXARY, the trading name of the French sole trader ABAKAR HASSAN Mahamat, whose establishment is located at 39 rue de la Wantzenau, 67116 Reichstett, France.

2. Purpose and scope

These Terms and Conditions govern distance sales of cosmetic products between OXARY and consumers purchasing through oxary.co. They are made available before checkout and prevail over any other document, subject to mandatory consumer law. By placing an order, the customer confirms that they have read and accepted them.

3. Products

Each product page sets out the essential characteristics, ingredients, size, price and directions for use. Photographs are prepared with care but minor differences in colour, appearance or packaging are not contractually binding.

Offers are subject to availability. If a product becomes unavailable after an order has been placed, OXARY will inform the customer and refund any amount paid for that product.

4. Prices, taxes and charges

Prices are displayed in euros. The VAT treatment applicable to the order is shown at checkout and on the invoice. Delivery charges and any import taxes, customs duties or other charges are shown before the order is confirmed when they can be calculated by OXARY. For destinations outside the European Union, charges imposed by authorities or carriers may remain payable by the recipient.

OXARY may change its prices at any time. The price charged is the price displayed when the order is confirmed, except where there is an obvious pricing error, in which case the customer will be informed before the order is processed.

5. Orders

The customer selects the products and checks their basket, identity, address, delivery method and total price. Errors can be corrected before confirmation. Final confirmation using the button indicating an obligation to pay forms the contract and requires payment.

An order confirmation is sent by email. OXARY may refuse or cancel an order for a legitimate reason, including suspected fraud, payment failure, lack of stock or clearly inaccurate information. Any amount already collected for an order cancelled by OXARY will be refunded.

6. Payment

Payment is due in full when the order is placed, using one of the methods offered at checkout. Transactions are processed by the payment providers available through Shopify. OXARY does not retain the customer’s complete card details. If payment is declined, the order is not confirmed.

7. Processing and delivery

Orders are generally prepared within 2 to 3 business days after payment has been confirmed. Destinations, estimated delivery times, rates and tracking arrangements are described in the Shipping Policy. The applicable delivery date or period is also provided before the order is placed.

The customer must provide a complete and accurate address. OXARY remains responsible for delivery until the customer, or a third party appointed by the customer, takes physical possession of the parcel, except where the customer independently chooses a carrier not offered by OXARY.

If delivery exceeds the stated period or, where no period was stated, 30 days after the order, the customer may formally request performance within a reasonable additional period and may then terminate the contract in accordance with applicable law. Any amount due will be refunded within the statutory period.

8. Receipt and claims

Customers should inspect the parcel and products on delivery. If a product is missing, damaged, defective or different from the item ordered, the customer should promptly contact contact@oxary.co with the order number and, where possible, photographs. This procedure does not restrict statutory rights.

9. Right of withdrawal and returns

Consumers have 14 days from receipt of the goods to notify OXARY of their decision to withdraw, without giving a reason. Notice may be sent to contact@oxary.co or to OXARY, 39 rue de la Wantzenau, 67116 Reichstett, France, using the form at the end of these Terms or any other clear statement.

After giving notice, the product must be returned within the statutory period and in accordance with the instructions provided. Direct return costs are payable by the customer unless the product is defective, non-conforming or was sent in error by OXARY.

For health protection and hygiene reasons, the right of withdrawal does not apply to a sealed cosmetic product that has been unsealed after delivery. This exception does not affect rights relating to defective or non-conforming products.

OXARY also offers a commercial return extension of up to 30 days, subject to the Returns and Refunds Policy.

10. Refunds

Following a valid statutory withdrawal, OXARY refunds all amounts legally due, including the initial standard delivery charge. Refunds are made no later than 14 days after notice of withdrawal. OXARY may withhold the refund until the goods are recovered or evidence of dispatch is supplied, whichever occurs first. The refund is issued to the original payment method unless expressly agreed otherwise.

11. Statutory guarantees

LEGAL GUARANTEE OF CONFORMITY AND HIDDEN DEFECTS

Consumers have two years from delivery to rely on the French legal guarantee of conformity where a lack of conformity appears. During that period, the consumer only needs to establish the existence of the defect, not the date on which it arose.

Conformity must be restored free of charge, without significant inconvenience and within a maximum of 30 days. Subject to the statutory conditions, the consumer may request replacement, a price reduction or termination of the contract. A sufficiently serious lack of conformity may justify an immediate price reduction or termination.

These rights arise under Articles L. 217-1 to L. 217-32 of the French Consumer Code. Consumers also benefit from the guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect.

12. Product use and liability

OXARY products are cosmetic products intended for personal, external use. Customers must follow the precautions, directions and ingredient lists shown on the product and its product page. In the event of a known allergy, highly reactive skin, medical uncertainty or an adverse reaction, customers should not use or should stop using the product and seek advice from a healthcare professional.

To the extent permitted by law, OXARY is not responsible for damage caused by use that is clearly contrary to the instructions, alteration of the product by the customer or misuse. Nothing in these Terms excludes or restricts OXARY’s statutory liability, rights relating to defective products or mandatory consumer guarantees.

13. Intellectual property

The OXARY brand, logos, copy, photographs, videos, visuals and creative materials are protected by intellectual property rights. Reproduction or commercial use without prior written permission is prohibited except where permitted by law. Products are intended for the customer’s personal use and may not be resold professionally without OXARY’s written consent.

14. Personal data

Personal data processing connected with orders, payments, deliveries and communications is described in the Privacy Policy. Customers may exercise their rights by emailing contact@oxary.co.

15. Force majeure

Neither party is responsible for delay or non-performance directly caused by an event of force majeure under French law. The affected party will inform the other party as soon as reasonably possible. If the event continues, statutory termination rights remain available.

16. Complaints and consumer mediation

Complaints should first be sent to contact@oxary.co or to OXARY, 39 rue de la Wantzenau, 67116 Reichstett, France. OXARY will seek an amicable solution.

After a prior written complaint that has not been resolved, a consumer may use consumer mediation free of charge in accordance with Articles L. 612-1 and following of the French Consumer Code. The details of the mediator appointed by OXARY will be published on this page and provided to consumers once membership of the appropriate mediation scheme has been finalised.

17. Governing law and jurisdiction

These Terms are governed by French law, without depriving consumers residing in another country of any mandatory protection available to them. If an amicable solution cannot be reached, proceedings may be brought before the courts having jurisdiction under the consumer protection rules that apply.

18. Amendments and severability

The version applicable to an order is the version accepted when that order is placed. OXARY may amend these Terms for future orders. If any provision is held to be invalid, the remaining provisions continue to apply.

19. Model withdrawal form

Complete and return this form only if you wish to withdraw from the contract.
